1. Acceptance of Terms

By accessing and using the services provided by Brilavo Inc. (“Brilavo”), including the ExamA+ application, you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, please do not use Brilavo's services.

2. Eligibility and Accounts

• Brilavo's services are designed for students and their families. Accounts must be created by an adult parent or guardian, who is responsible for managing any student profiles under the account.
• Users agree to provide accurate and complete information when creating an account and to keep this information updated.
• The account holder is responsible for maintaining the confidentiality of account credentials and for all activity under the account.

3. Use of Services

• Brilavo allows users to create accounts, access educational content and practice exercises, track learning progress, and subscribe to paid plans from desktop or mobile devices.
• The services may be used only for lawful, personal, and educational purposes. Users may not copy, redistribute, or resell Brilavo's educational content.

4. Content

• Users retain all rights to content they submit but grant Brilavo a non-exclusive, royalty-free license to use such content in connection with the services.
• Users confirm they own or have the necessary rights to submitted content and that it does not infringe any third party's rights.
• All educational content, curricula alignments, exercises, and software provided by Brilavo remain the exclusive property of Brilavo Inc. or its licensors.

5. Data Collection and Sharing

• Brilavo does not sell or rent personal information. Data collected is shared only with service providers essential to operating the platform (such as cloud hosting, payment processing, and analytics providers), bound by confidentiality obligations, and with parents or guardians regarding their own child's progress.
• Data collection, sharing, and processing comply with PIPEDA, Québec's Act respecting the protection of personal information in the private sector (as amended by Law 25), and other applicable legislation.

6. Reference to Existing Policies

This agreement is in compliance with and references our Information Privacy Policy, Security Policy, Data Erasure Policy, and Personal Information and Security Policy.

7. Purchases and Subscriptions

• When purchasing subscriptions or services from Brilavo, users agree to ensure full payment, including applicable taxes and fees.
• Subscriptions renew automatically unless cancelled before the renewal date. Users may cancel at any time from the account area; cancellation takes effect at the end of the current billing period and no further charges are made.
• Before each renewal, Brilavo sends the account holder a reminder stating the renewal date and the renewal price.
• Prices are displayed prior to purchase and may change with reasonable prior notice before the next renewal.

8. Privacy

Brilavo respects the privacy of its users, particularly children. The collection, use, and sharing of personal information are governed by Brilavo's Information Privacy Policy.

9. Security

Brilavo is committed to ensuring the security of user data as outlined in our Security Policy.

10. Data Erasure

In accordance with our Data Erasure Policy, Brilavo will securely erase user data when it is no longer needed or upon request by the account holder. See Delete your account.

11. Limitation of Liability

To the maximum extent permitted by law, Brilavo shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or in connection with the use of its services. Brilavo's services are a study aid and do not guarantee any particular examination result.

12. Governing Law

These Terms shall be governed by the laws of the Province of Québec and the laws of Canada applicable therein. Any legal actions or proceedings related to this agreement will be exclusively subject to the jurisdiction of the courts of Québec, Canada, in the judicial district of Montréal.

13. Modifications to Terms

Brilavo reserves the right to modify these Terms at any time. Material changes will be communicated to account holders, and users are advised to review these Terms periodically.
